Important notice before booking: Participation in catskiing and catboarding trips with RAW.MOUNTAIN is voluntary and entirely at your own risk. Freeriding in alpine terrain is a high-risk sport. By making a booking, you confirm that you have read, understood and accepted these Terms & Conditions in full.
These General Terms and Conditions apply to all travel services offered and arranged by RAW.MOUNTAIN (owner: Ferdi Christ, hereinafter "Organiser"). By making a booking, a travel contract is concluded between the booking party (hereinafter "Participant") and RAW.MOUNTAIN.
Any conflicting terms and conditions of the Participant shall not be recognised unless the Organiser has expressly agreed to them in writing.
RAW.MOUNTAIN acts towards the Participant as a package travel organiser within the meaning of the EU Package Travel Directive (EU) 2015/2302, as implemented in German law under §§ 651a ff. BGB. All rights and obligations of a tour operator under German and EU law apply accordingly.
RAW.MOUNTAIN is legally required to protect customer payments against insolvency. The insolvency protection certificate will be provided to the Participant after booking confirmation together with all travel documents. [Insolvency protection provider and certificate number to be inserted here]
Prior to the conclusion of the travel contract, RAW.MOUNTAIN shall provide the Participant with all legally required information, in particular:
This information will be made available to the Participant before booking via the website and/or by email and forms part of the contract.
The travel contract is concluded once RAW.MOUNTAIN confirms the Participant's booking request in writing (by email). The place is considered bindingly reserved upon receipt of the deposit. The Participant will receive a booking confirmation and all legally required travel documents.
The scope of contractually owed travel services is determined exclusively by the respective travel description on raw-mountain.com and the written booking confirmation. Any verbal side agreements require written form.
A booking is concluded upon written confirmation (email) by RAW.MOUNTAIN. The place is considered reserved only upon receipt of the deposit.
Payment of the deposit and the remaining balance shall be made exclusively by bank transfer or PayPal. Other payment methods are not accepted. Bank details and the PayPal address will be provided to the Participant with the booking confirmation. Payment is deemed received once the amount has been credited to the RAW.MOUNTAIN account.
RAW.MOUNTAIN reserves the right to increase the agreed travel price after conclusion of the contract in the event of increases in transport costs, taxes or fees, or exchange rates, in accordance with EU Package Travel Directive Art. 10. A price increase is only permissible up to 8% of the original travel price and must be communicated to the Participant at least 20 days before departure. For increases exceeding 8%, the Participant has the right to withdraw from the contract free of charge.
If the costs underlying the price calculation decrease after conclusion of the contract, RAW.MOUNTAIN is obliged to reduce the travel price accordingly and refund the difference to the Participant.
If RAW.MOUNTAIN must significantly alter a main characteristic of the travel services before departure (e.g. change of hotel to comparable standard, cancellation of a riding day due to avalanche closure or force majeure), the Participant will be informed immediately and may either accept the change or withdraw from the contract free of charge with full refund of all payments made.
Riding days lost due to weather conditions, avalanche warnings or official orders constitute force majeure and do not entitle the Participant to a refund.
If the remaining balance is not paid by the due date 45 days before departure, the Participant automatically enters into default. RAW.MOUNTAIN is then entitled to:
RAW.MOUNTAIN will send at least one written payment reminder by email before initiating further steps.
The Participant may request a rebooking (e.g. change of travel date) in writing (by email). The following conditions apply to rebookings:
There is no entitlement to rebooking. RAW.MOUNTAIN will endeavour to accommodate rebooking requests but may decline in the event of fully booked dates or for organisational reasons, in which case the cancellation conditions apply.
The Participant may withdraw from the contract at any time before the start of travel. Withdrawal must be made in writing (by email). The date on which the cancellation notice is received by RAW.MOUNTAIN is decisive. Day 45 before the start of travel is the last day on which cancellation is free of charge. The following cancellation fees apply:
Recommendation: We strongly recommend taking out trip cancellation insurance. RAW.MOUNTAIN accepts no liability for costs arising from unforeseen events that necessitate cancellation.
RAW.MOUNTAIN reserves the right to cancel the trip if the minimum number of participants is not reached or if force majeure makes safe execution impossible. Force majeure includes in particular:
In the event of cancellation by RAW.MOUNTAIN due to force majeure, the full travel price paid will be refunded. Claims beyond this — in particular for reimbursement of flight costs or other travel expenses — are excluded. We therefore strongly recommend taking out trip cancellation and trip interruption insurance.
If the Participant does not use individual travel services that were properly offered, for reasons attributable to the Participant (e.g. early departure, illness, missed riding days, own fault), there is no entitlement to a proportionate refund. This applies in particular to:
RAW.MOUNTAIN will endeavour to seek a refund of saved costs from service providers where possible, but is not obliged to do so.
Participation in RAW.MOUNTAIN trips requires the following conditions to be met:
RAW.MOUNTAIN trips are not suitable for beginners. The Organiser reserves the right to exclude Participants who do not meet the physical or technical requirements from participation — without entitlement to a refund of the travel price.
RAW.MOUNTAIN offers trips for solo travellers, couples and small groups. Bookings are grouped together up to a maximum of 14 persons. Solo travellers and small groups may be combined with further participants from other bookings.
Groups of at least 10 persons may request an exclusive private snowcat. In this case, the addition of further guests remains at the Organiser's discretion and may be implemented in consultation with the group.
There is no entitlement to a minimum group size or a specific group composition.
By making a booking, the Participant expressly confirms that no physical or health conditions exist that could endanger safe participation in the catskiing or catboarding trip. Any pre-existing conditions that may affect participation must be disclosed to RAW.MOUNTAIN before booking is finalised. RAW.MOUNTAIN accepts no liability for damages resulting from undisclosed pre-existing conditions.
During the trip, photos and videos may be taken in which Participants appear. By making a booking, the Participant consents to RAW.MOUNTAIN using such recordings for marketing purposes (website, social media, print). This consent may be revoked in writing at any time. Revocation does not affect the lawfulness of use prior to revocation.
Catskiing and catboarding in alpine terrain are high-risk activities. Participation is entirely at the Participant's own risk and responsibility. By making a booking, each Participant confirms they are aware of the associated risks and accept them voluntarily and on their own responsibility.
The Participant expressly declares that:
RAW.MOUNTAIN accepts no liability for:
Each Participant is solely liable for any damage caused to third parties or third-party property by their own equipment (snowboard, skis, bindings, helmets, accessories etc.). RAW.MOUNTAIN accepts no liability for damage caused by a Participant's own equipment. Taking out personal liability insurance is strongly recommended.
Note: The above exclusions of liability apply to the extent permitted by law. Under German law, liability for intent and gross negligence, as well as for personal injury arising from slight negligence, remains unaffected.
The Participant undertakes to:
In the event of serious violations, RAW.MOUNTAIN reserves the right to exclude the Participant from further participation. No entitlement to a refund exists in such cases.
Participation in catskiing and catboarding activities under the influence of alcohol, drugs or reaction-impairing medication is expressly prohibited. In the event of a violation, the guide is entitled to immediately exclude the Participant from the activity — without entitlement to a refund.
RAW.MOUNTAIN offers catskiing and catboarding trips as group travel. By making a booking, the Participant acknowledges that:
RAW.MOUNTAIN endeavours to group riders by ability level and to make adjustments for the following day in the event of significant differences. However, there is no legal entitlement to regrouping. If regrouping cannot be arranged for organisational or capacity reasons, this does not entitle the Participant to a reduction in the travel price.
Every Participant is required to take out insurance before departure covering at least:
Proof of valid insurance may be requested before or at the start of travel. RAW.MOUNTAIN accepts no liability for costs arising from absent or insufficient insurance cover.
Personal data is collected, stored and used exclusively for the processing of the travel contract. Data is only disclosed to third parties where necessary for the execution of the trip (e.g. hotel, local partner in North Macedonia, transport providers). The provisions of the GDPR apply. A separate privacy policy is available on the RAW.MOUNTAIN website and forms part of these Terms & Conditions.
RAW.MOUNTAIN reserves the right to amend these Terms & Conditions at any time. The version in force at the time of booking shall apply. Should any individual provision of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
If the trip is not provided in accordance with the contract, the Participant must immediately report the defect to the on-site guide and request remedy. Notification of defects only after the end of the trip does not give rise to any claim for reduction or damages if the notification was negligently omitted.
Claims arising from non-contractual provision of travel services must be submitted to RAW.MOUNTAIN in writing (by email) within one month of the contractually scheduled end of the trip. After expiry of this period, claims may only be asserted if the Participant was prevented from meeting the deadline without fault.
Claims by the Participant arising from the travel contract are subject to a limitation period of two years. The limitation period begins on the day following the contractually scheduled end of the trip. Claims for personal injury or damage to health arising from intentional or grossly negligent breach of duty are subject to the statutory limitation periods.
RAW.MOUNTAIN may terminate the travel contract without notice and exclude the Participant from further participation if the Participant:
For particularly serious violations (especially criminal offences or acute endangerment of other Participants), immediate exclusion without prior warning is permissible.
If RAW.MOUNTAIN terminates for behavioural reasons, the Organiser retains the right to the full travel price. No entitlement to a refund exists. Any costs of return travel shall be borne by the Participant.
RAW.MOUNTAIN informs EU nationals before conclusion of the contract about the passport, visa and main health requirements applicable to North Macedonia. Any changes to these requirements up to the start of travel will be communicated to the Participant without delay.
The Participant is solely responsible for:
Any disadvantages arising from failure to comply with these requirements (e.g. cancellation costs due to missing entry documents) shall be borne by the Participant. Nationals of non-EU countries should consult the relevant consulate for applicable entry requirements.
For travel contracts for package holidays that take place at a specific date or within a specific period, there is no statutory right of withdrawal pursuant to § 312g para. 2 no. 9 BGB (German Civil Code). The cancellation and withdrawal conditions set out in these Terms & Conditions (§ 6) apply exclusively.
German law applies exclusively.
The place of jurisdiction for claims by the Participant against RAW.MOUNTAIN is Kempten im Allgäu, to the extent permitted by law. For claims by RAW.MOUNTAIN against the Participant, the Participant's place of residence shall apply. For Participants residing outside Germany or with no known place of residence at the time of filing, Kempten im Allgäu is agreed as the place of jurisdiction.
The governing language of this contract is German. Translations of these Terms & Conditions into other languages (English, Spanish, Dutch) are provided for information purposes only. In the event of a dispute, the German-language version shall prevail. Official communication between RAW.MOUNTAIN and the Participant shall be conducted in German or English.
